J.G. PETRUCCI DEVELOPMENT GAINS APPROVAL TO MOVE FORWARD WITH COMPLEX COMMERCIAL DEVELOPMENT PROJECT THROUGH EFFORTS OF FARER FERSKO
 

Farer Fersko has successfully assisted our client J.G. Petrucci Development in obtaining Preliminary Site Plan and variance approvals on a significant and complex warehouse and distribution center project in Edison Township, New Jersey. The firm’s efforts were led by John H. Hague and Jeffrey W. Cappola, who called upon their extensive experience with municipal and state land use issues to gain approvals and resolve objections raised by a local environmental advocacy group.

In March 2006, an application was filed with the Edison Township Planning Board on behalf of a Petrucci development affiliate, proposing the construction of a 570,000 square foot distribution, warehouse and office building in the Raritan River Revitalization District. The site contains a landfill that was closed in 1985 and is bordered by coastal wetlands. A 100 foot wetlands buffer was required by NJDEP as part of a Waterfront Development Permit.

Objections to the application were based primarily upon concerns related to the management of existing landfill waste, gas emissions and the potential for surface water contamination to be generated by disturbance of the landfill during construction. Farer Fersko successfully addressed these concerns through skillful advocacy and negotiation based upon data generated by environmental consultants, architects and engineers on the Petrucci team. The firm is proud to have obtained the requisite approvals, variances and waivers that will enable our client to move forward with development in a timely and cost-effective manner.
