David Farer and Ann Waeger Set for ALI-ABA Webcast on Environmental Insurance

David B. Farer and Ann M. Waeger , directors in our firm, will participate on the faculty of the American Law Institute-American Bar Association (ALI-ABA) webcast “Strategies for Negotiating Environmental Insurance Policies and Avoiding Claim Pitfalls” on Tuesday, September 23.

The program will originate live from New York City, and will feature a discussion of critical strategies and goals associated with the negotiation of environmental insurance policies to obtain the most effective coverage and avoid claim disputes. Best practices concerning claims handling from the perspective of both the policyholder and the insurer will also be discussed. The faculty will offer an in-depth analysis on topics including:

Negotiating the terms of an environmental liability insurance policy to maximize coverage

Critical policy terms as they affect desired coverage, including known conditions, trigger of coverage, notice, natural resource damages, capital improvements, and change in use

The claims handling process

General trends in claims, including the types of claims being made and latest case law
